We strongly recommend monitoring the Visa Bulletin and Adjustment of Status regularly,  as monthly changes can significantly affect your immigration strategy.

Key Updates for October – Employment-Based Categories (EB-1A and EB-2 NIW):

1/ Important Note:
USCIS has confirmed that for October 2025, applicants in employment-based categories must use the Dates for Filing chart for Adjustment of Status filings. This change opens the door for many applicants to file sooner than before.

2/ First Preference – EB-1
Aliens of Extraordinary Ability, Outstanding Professors and Researchers, Certain Multinational Managers or Executives

  • All Chargeability / Mexico / Philippines: Current – no change
  • China (mainland born): 01Jan 23 to 15May 23 – forward ~4.5 month
  • India: 15Apr 22 to 15Apr 23 – forward 12 month

This is a significant improvement, especially for Indian and Chinese nationals in the EB-1 category, offering earlier filing opportunities.

3/ Second Preference – EB-2 NIW
Members of the Professions Holding Advanced Degrees or Aliens of Exceptional Ability

  • All Chargeability / Mexico / Philippines: 15Nov 23 to 15Jul 24 – forward 8 month
  • China (mainland born): 01Jan 21 to 01Dec 21 – forward 11 month
  • India: 01Feb 13 to 01Dec 13 – forward 10 month

This is one of the most significant forward movements in months, particularly for Rest of World applicants under EB-2 NIW (i.e., all countries except China, India, Mexico, and the Philippines), who can now file nearly a year earlier than before.
