I, the client, hereby retain McGettrick Law PLLC (“Law Firm”) to provide me with legal representation on the terms set out below. I understand and agree that this representation is limited both in scope and time, as described below.
With respect to the scope of this legal representation agreement, the only task that I am asking Law Firm to perform for me, and the only task Law Firm is agreeing to perform for me, is to prepare and file for me my proposed application and/or petition with the proper federal government agency.
I acknowledge and understand that, sometimes, for different reasons, the government agency with whom an application or petition like this is filed may request more information from me, by means of what is called a “Request for Evidence.” I agree that this representation will not include any assistance from Law Firm in responding to any such requests. I agree that, if the government agency does make a further request for more information, Law Firm is under no obligation to perform any further work for me under this representation agreement. I also understand that, if that happens, and if I then do want Law Firm to assist me further, the Law Firm will consider doing so, but will require that I enter into a new representation agreement. I also understand that the fee I have agreed to pay in this representation agreement WILL NOT include any such further work or representation.
I understand and agree that Law Firm IS NOT AGREEING TO GIVE ME MORE HELP than agreed to in this legal representation agreement and IS NOT AGREEING TO HELP WITH ANY OTHER MATTER. I understand and agree that Law Firm’s representation of me will last only for a limited period of time.
Specifically, I understand and agree that, once the work described above is done, and once an application and/or petition is filed, Law Firm’s work for me will end, except that Law Firm will continue to monitor the progress of my application and/or petition and notify me of that progress.
I also understand and agree that neither I nor Law Firm are agreeing to any further or future representation of me by Law Firm, and no such further or future representation is included as a part of this limited representation. Any further or future representation outside the terms of this legal representation agreement will only arise if I and Law Firm agree to another representation in a written agreement separate from this one.
I understand and agree that, in order to receive appropriate assistance from Law Firm, the information I provide need to be complete, accurate, and truthful. Further, I am aware that providing false information to U.S. immigration authorities may be a crime and may lead to serious negative consequences for me, including denial of the relief I am seeking, and other immigration-related penalties outlined in the Immigration and Nationality Act and other federal statutes. I hereby confirm the information I have provided or will provide Law Firm is complete, accurate, and truthful.
I understand and agree that, while performing the limited legal services called for under this legal representation agreement, Law Firm: (i) has relied entirely on the facts I have provided and will not make any independent investigation of the facts; and (ii) may recommend (but is not required to do so) that I seek additional legal advice from an attorney.
I also understand that, in order to receive appropriate assistance from Law Firm, I must be responsive to communications from Law Firm. I also agree that I must keep Law Firm informed about how to communicate with me and that, if I fail to do so, Law Firm may well be unable to carry out this representation or perform the services I have engaged it to perform and may withdraw from this representation.
I understand that Law Firm agrees to use its best efforts in representing me, but that Law Firm cannot assure a favorable result.
As compensation for providing this legal representation to me, I agree to pay to Law Firm a fee of [Attorney fee amount automatically inserted]. I agree that this entire fee is earned when an application and/or petition. I understand and agree that, between the time this fee is paid and the time this entire fee is earned, the fee will be kept in a trust account. I also understand and agree that, as soon as an application and/or petition is filed, this entire earned fee belongs to Law Firm and I authorize the Law Firm to then remove that entire fee from the trust account and treat this fee as Law Firm’s property. I understand and agree that this attorney fee will be solely the Law Firm’s, and that no part of this attorney fee will be shared with anyone else, including PassRight in any respect. I consent and agree that any funds that may or must be held in a trust account will be subject to the law and rules governing trust accounts for Texas lawyers and that any such trust account may be at a financial institution in Texas.
I HAVE READ THIS LEGAL REPRESENTATION AGREEMENT AND THOROUGHLY UNDERSTAND AND ACCEPT ITS CONDITIONS. I UNDERSTAND THAT, IF I HAVE ANY QUESTIONS, CONCERNS, OR UNCERTAINTY ABOUT THE TERMS AND CONDITIONS OF THIS AGREEMENT, I CAN AND SHOULD ASK QUESTIONS AND HAVE THEM RESOLVED BEFORE AGREEING TO THIS LEGAL REPRESENTATION AGREEMENT. I UNDERSTAND THAT A COPY OF THIS THIS LEGAL REPRESENTATION AGREEMENT WILL BE DELIVERED TO THE EMAIL ADDRESS I PROVIDED WHEN SUBMITTING MY QUESTION.
This legal representation agreement shall become effective, and Law Firm’s representation of me will begin upon my indication that I have agreed to this agreement and the completion of my payment to Law Firm.
I expressly acknowledge Shop Immigration, Inc., doing business under the name “PassRight,” (“PassRight”) is a service provider to Law Firm, that PassRight is not a law firm, that I am not looking to PassRight to perform any legal services, that I have no agreement with PassRight, and that this legal representation agreement is only between me and Law Firm and that PassRight is not a party to this agreement.
This legal representation agreement shall be governed by the laws of Texas, the jurisdiction in which Law Firm is licensed to practice.
Texas law (Tex. Gov’t Code § 81.079) requires that all attorneys provide their clients with the following notice about the existence of the attorney grievance process: “The State Bar of Texas investigates and prosecutes professional misconduct committed by Texas attorneys. Although not every complaint against or dispute with a lawyer involves professional misconduct, the State Bar’s Office of Chief Disciplinary Counsel will provide you with information about how to file a complaint. Please call 1-800-932-1900 toll-free for more information.”
This legal representation agreement contains the entire understanding and agreement between Law Firm and me with respect to the legal representation being provided.
